Terms of Service
These Terms are an agreement between you and [LEGAL ENTITY NAME] ("Mello", "we", "us") for the Mello app and assistant. By creating an account or using Mello, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use Mello.
1. What Mello is
Mello is a personal relationship assistant. It helps you remember the people and moments that matter and helps you show up for them — over iMessage or Telegram, in the app, and by voice. Mello drafts messages and suggests when to reach out; you decide what to send and when.
2. Eligibility
You must be at least [13 / 16 / 18] and able to form a binding contract to use Mello. If you use Mello on behalf of an organization, you represent you're authorized to accept these Terms for it.
3. Your account
You sign in with a phone number or email. Keep your account secure and don't share access. You're responsible for activity under your account. Tell us promptly at [support@mello.app] if you suspect unauthorized use.
4. How Mello communicates with you
- You choose the channel (iMessage or Telegram) and connect it. Messages are delivered through third-party services and your own carrier or messaging provider; their terms and charges apply to your use of them.
- Mello may contact you proactively — reminders, nudges, and, if you enable it, calls — based on the cadence you set. You can change or turn these off in the app.
- Mello does not send messages to other people on your behalf. When Mello helps you reach out to someone, it prepares a draft in your messaging app and you send it yourself.
5. Your responsibilities
You agree that you will:
- Provide accurate information and keep it current.
- Only share information about other people where it's appropriate for you to do so, and not share someone else's sensitive information without a legitimate reason. You are responsible for the information you give Mello about others and for any messages you choose to send.
- Use Mello lawfully and not to harass, deceive, spam, or harm anyone, and not to violate anyone's privacy or rights.
- Not misuse the service: no reverse-engineering, scraping, interfering with or overloading it, probing security, or using it to build a competing product, except where the law says such restrictions can't apply.
We may suspend or limit accounts that break these rules or put others or the service at risk.
6. Mello is an assistant, not an authority
Mello uses artificial intelligence, and AI can be wrong. Its suggestions, summaries, reminders, and drafted messages may be inaccurate, incomplete, or mistimed. Use your judgment and verify anything important before you act on it. Mello is for personal relationship-keeping; it is not professional advice of any kind — not medical, legal, financial, or mental-health advice — and is not a substitute for a professional. Proactive nudges are help, not obligations.
7. Your content, and our brand
- You keep your content. The people, notes, plans, photos, and messages you put into Mello remain yours.
- You give us the permission we need to run Mello. You grant us a worldwide, non-exclusive, royalty-free license to host, process, transmit, and display your content, and to share it with the service providers described in the Privacy Policy, solely to operate and improve Mello for you. This license ends when you delete the content or your account, except for copies we must retain by law or in routine backups.
- You confirm you have the rights to the content you provide, including information about other people and any photos you upload.
- Our brand is ours. "Mello", the Mello logo, character, and look are our property. These Terms don't give you a license to use them.
- Feedback you send us can be used freely, without obligation to you.
8. Third-party services
Mello works with third-party services — including Apple, your messaging provider (iMessage/Telegram), and our AI providers. Your use of those services is subject to their terms, and we're not responsible for them. If you got Mello through the Apple App Store, Apple's standard licensed-application terms also apply, and Apple is not responsible for Mello or for support. 9. Availability, changes, and beta
Mello is offered as-is and as-available. We may add, change, suspend, or remove features, and there may be interruptions, bugs, and data issues, especially during beta. We'll try to give notice of significant changes, but we may act immediately to protect the service or its users.
10. Disclaimers
To the fullest extent permitted by law, Mello is provided without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that Mello will be uninterrupted, error-free, or that its outputs will be accurate or reliable. 11. Limitation of liability
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, missed occasions, or messages sent or not sent. Our total liability for any claim relating to Mello is limited to [the greater of the amount you paid us in the 12 months before the claim, or US$100]. 12. Indemnification
You agree to indemnify and hold us harmless from claims arising out of the content you provide (including information about other people), the messages you send, or your misuse of Mello or violation of these Terms, to the extent permitted by law.
13. Termination
You can stop using Mello and delete your account at any time from the app. We may suspend or end your access if you break these Terms or to protect the service. Sections that by their nature should survive termination (content license we still need for backups, disclaimers, liability limits, indemnification, and dispute terms) survive.
14. Governing law and disputes
These Terms are governed by the laws of [JURISDICTION], without regard to conflict-of-laws rules. 15. Changes to these Terms
